1. Acceptance of Terms

By creating an account or using the MarketPulse service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

MarketPulse is a Model Context Protocol (MCP) server that provides AI assistants with access to financial indicators, market data, and related tools via HTTPS API calls. The Service is provided on a serverless architecture hosted on Amazon Web Services (AWS).

3. Open Beta

The Service is currently offered as an open beta. During the beta period:

  • Each account receives 1,000 tool calls per calendar month at no cost.
  • No credit card or payment is required.
  • The Service may be discontinued, modified, rate-limited, or access-restricted at any time without prior notice.
  • No service-level agreements (SLAs) or uptime guarantees are provided.
  • Token allocations may change without notice.

4. Not Investment Advice

MarketPulse provides technical indicators and market data for informational and educational purposes only. The information provided does not constitute investment advice, financial advice, trading advice, or any other sort of advice, and you should not treat any of the Service's content as such.

MarketPulse does not recommend that any financial instrument should be bought, sold, or held by you. Do conduct your own due diligence and consult a qualified financial advisor before making any investment decisions.

Past performance is not indicative of future results. Signals such as "BULLISH", "BEARISH", "OVERBOUGHT", or "OVERSOLD" are purely mathematical outputs of standard technical analysis formulas and are not recommendations to buy or sell any asset.

5. Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARKETPULSE AND ITS OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or other intangible losses;
  • Any investment or trading decisions made based on data provided by the Service;
  • Unauthorized access to or alteration of your account or API key;
  • Interruption, suspension, or cessation of the Service;
  • Inaccurate, delayed, or incomplete market data;
  • Actions or omissions of third-party data providers (including Polygon.io).

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED ZERO EUROS (€0), AS THE SERVICE IS PROVIDED FREE OF CHARGE DURING THE BETA PERIOD.

6. Indemnification

You agree to indemnify, defend, and hold harmless MarketPulse and its operators from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of or reliance on the Service;
  • Your violation of these Terms;
  • Any investment or trading decisions you make;
  • Your violation of any applicable law or regulation.

7. Data Accuracy Disclaimer

Market data is sourced from third-party providers, including Polygon.io. MarketPulse makes no warranty regarding the accuracy, completeness, reliability, or timeliness of any data or indicator. Data may be delayed, incorrect, or unavailable. Technical indicators are computed using standard formulas and may contain mathematical approximations.

THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Fair Use Policy

Open beta accounts receive 1,000 tool calls per calendar month. The following activities are prohibited and may result in immediate account termination without notice:

  • Automated scraping, crawling, or systematic extraction of data;
  • Redistribution, resale, or sublicensing of data obtained through the Service;
  • Creating multiple accounts to circumvent usage limits;
  • Any use that interferes with or disrupts the Service;
  • Reverse engineering or attempting to extract source code.

9. Account and API Key Security

You are responsible for safeguarding your API key. Do not share your key or commit it to public repositories. MarketPulse is not liable for unauthorized use of your API key. If you believe your key has been compromised, regenerate it immediately via the dashboard.

10. Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, for any reason, including but not limited to violation of these Terms or suspected abuse of the Service.

You may delete your account at any time by contacting us at alerts.marketpulse@gmail.com. Upon deletion, your API key will be revoked and your data will be removed within 30 days.

11. Intellectual Property

The Service, its design, code, documentation, and branding are the property of MarketPulse. Market data is the property of its respective providers. Your use of the Service does not grant you any ownership rights.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or the Service shall be resolved under the jurisdiction applicable to the Service operator.

If you are a consumer within the European Union, you also have the right to bring proceedings in the courts of your country of residence, and nothing in these Terms shall affect your statutory consumer rights under applicable EU law.

13. Modifications to Terms

We may update these Terms at any time by posting the revised version on this page. The "Last updated" date at the top will reflect the change. Continued use of the Service after any changes constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
